TERMS OF SERVICE

1. WHO WE ARE

References to “we”, “us” and “Cookes Games” mean COOKE'S RETAIL LTD. “You” means the person placing an order. These terms do not affect your statutory rights as a consumer.

2. PLACING AN ORDER AND WHEN A CONTRACT FORMS

Placing an order is an offer to buy. When you complete payment you'll receive an order confirmation with a reference number, but this is an acknowledgement, not an acceptance. A contract is formed when we dispatch the goods. Until dispatch we may decline or cancel an order, for example because stock has run out, a price or description was wrong, an order exceeds a household limit, or we can't verify the payment. If we cancel, we refund in full.

3. PRICES AND PAYMENT

All prices are in pounds sterling and include VAT at the current rate. Delivery is charged as set out on our delivery page and shown before you pay. Payment is taken in full at checkout through Stripe, which accepts major debit and credit cards, Apple Pay and Google Pay. We never see or store your card details.

We check prices carefully, but if a product is listed at an obviously wrong price we may cancel the order and refund you rather than supply it at that price.

4. AVAILABILITY

Stock levels shown on the site are updated regularly but are not live. If an item you ordered turns out to be unavailable we'll tell you as soon as possible and refund the affected line. Products marked “sold out” cannot be ordered.

5. HOUSEHOLD PURCHASE LIMITS

Trading card product is often allocated to us in limited quantities. We may set a maximum quantity per product, per order or per household, and we may reduce or cancel orders that exceed it, including multiple orders placed to the same address or by the same person. Quantities are limited to 10 of any one line per order.

6. DELIVERY

We deliver to UK mainland addresses only. Dispatch and delivery times are set out on the delivery page. Risk in the goods passes to you on delivery; title passes when we have received payment in full.

7. CANCELLATION AND RETURNS

Your statutory 14-day right to cancel and our 30-day returns window are explained on the returns and refunds page. Sealed product cannot be returned once opened.

8. PRODUCT INFORMATION

Product names, set names, logos and artwork belong to their respective owners, including The Pokémon Company International, Nintendo, Bandai, Disney and Ravensburger. We are an independent retailer and are not affiliated with or endorsed by them. Images are for illustration. The contents of sealed packs are randomised by the manufacturer and we make no representation about what any pack contains.

9. ACCEPTABLE USE

You agree not to use the site for anything unlawful, to place orders using false details or someone else's payment method, to use bots or scripts to place orders, or to interfere with the site's operation. We may refuse orders or block access where we reasonably suspect fraud or abuse.

10. OUR LIABILITY

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your rights under the Consumer Rights Act 2015. Subject to that, we are not liable for losses that were not foreseeable when the contract was made, for losses not caused by our breach, or for business losses, and our total liability for any order is limited to the price you paid for it.

11. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by events outside our reasonable control, such as carrier disruption, severe weather or supplier failure. We'll tell you if such an event affects your order and you may cancel for a full refund if the delay is significant.

12. PRIVACY

We handle your personal data as described in our privacy policy.

13. COMPLAINTS AND DISPUTES

If something has gone wrong, email contact@cookesgames.co.uk and we'll do our best to sort it out. If we can't resolve a dispute, you may be able to use the European Commission's online dispute resolution platform or contact Citizens Advice for free guidance.

14. GOVERNING LAW

These terms and any contract between us are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.

15. CHANGES

We may update these terms from time to time. The version in force when you place an order is the one that applies to it.
